The city has agreed to halt its mandate requiring merchants that sell tobacco to display the posters near the cash register.

The Health Department says the images of damaged lungs and teeth are powerful illustrations of the risks of smoking and are intended to keep New Yorkers from becoming addicted.

Tobacco companies are suing the city, claiming that the pictures violate the first amendment rights of the cigarette makers and vendors.

The city has agreed to stop enforcing the rule until the case is heard in federal court.

However, the Health Department will continue to distribute the posters and encourage their use.
