The Queens imam accused of tipping off admitted terrorist Najibullah Zazi made a brief appearance in court Tuesday, but did not enter a plea as had been expected.
Ahmad Wais Afzali is scheduled to be back in court Thursday afternoon.
Afzali is charged with telling Zazi that New York City Police Department detectives were after him and then lying about it to federal agents.
"Najibullah Zazi was not tipped off by Afzali. We've learned that Zazi was tipped off about the investigation when the Port Authority Police Department acting on instructions from the FBI stopped Zazi when he was coming into the city on the George Washington Bridge," said Afzali's attorney Ron Kuby.
"I have full faith in the justice systems, my attorney, God, my family, my friends, my community, you know. The truth will come out," Afzali said.
Kuby says he is working on some sort of agreement so his client would not have to go to trial.
Najibullah Zazi's father, who is accused of trying to destroy chemicals and other evidence, was expected to appear in a different hearing Tuesday.
Zazi himself pleaded guilty last week to plotting an attack on the city's subway system and is cooperating with federal prosecutors.
The Colorado airport shuttle driver is scheduled to be sentenced June 25th, when he is expected to receive life in prison without parole.
