Officers In Bell Shooting To Not Face Federal Charges

The Department of Justice determined Tuesday that three detectives acquitted in the shooting death of Sean Bell will not face federal civil rights charges.

Bell’s parents, who had been pushing for federal charges, say they are disappointed by the news they received today during their meeting with federal prosecutors.

"It's like day one all over again. People don't realize how bad it hurts over and over again," said Bell's father, William Bell.

"They can explain to you why and how they made that decision, but to me it's not fair," said Bell's mother, Valerie Bell.

Prosecutors say there is insufficient evidence that any of the law enforcement personnel involved acted willfully.

The Department of Justice released a statement saying, "Neither accident, mistake, fear, negligence, nor bad judgement is sufficient to establish a federal criminal rights violation."

Police fired 50 shots at Bell and his two friends outside a Jamaica strip club in November 2006, on what was to be Bell's wedding day. The detectives believed that one of the men was armed, but no weapon was ever recovered.

The case sent shockwaves through the city, and the detectives' acquittal on criminal charges in April 2008 sparked outrage and protests.

While the New York City Police Department did not comment on Tuesday's decision, NYPD officials said in a statement that the department has formed an undercover review committee, instituted immersion training for police recruits and evaluated police firearm training.

Five officers involved with the Bell shooting remain on modified assignment, meaning that they are unarmed and not on enforcement duty, according to the NYPD.

Meanwhile, the Queens district attorney's office says it will cooperate in any disciplinary proceedings against the officers.
