A Manhattan judge ruled today against a motion to dismiss a criminal case against the man accused of blackmailing David Letterman.
Robert "Joe" Halderman, 52, had asked the judge to dismiss an attempted grand larceny charge.
The CBS "48 Hours" producer is accused of trying to extort $2 million from Letterman to keep quiet about his extramarital affairs.
But Halderman's lawyer, Gerard Shargel says the fight is not over.
"I made arguments that I continue to believe in," Shargel says. "The judge denied the motions. I've been litigiating criminal cases for a long time, it's on to the next step."
Shargel says Halderman was just offering the "Late Show" host a chance to buy and keep private a screenplay about his life.
Halderman is due back in court on March 9th.
If convicted, Halderman faces up to 15 years in prison.
