Report: Monserrate To Challenge Senate Punishment In Court

Embattled Queens State Senator Hiram Monserrate will reportedly go on the offensive in a bid to keep his seat.

According to the Daily News, Monserrate is planning to challenge in federal court any effort to expel him from the Senate.

A source tells the paper Monserrate will seek an injunction almost immediately after the Albany committee investigating his 2008 domestic abuse case releases its report, which is scheduled to be tomorrow.

Monserrate was convicted of misdemeanor assault after being caught on tape dragging his girlfriend Karla Giraldo, and was sentenced to three years probation. He was acquitted of felony charges that he intentionally slashed her in the face.

After nearly 10 weeks of investigation, committee members say the evidence provides for little more than a sanction.

Monserrate could lose his chairmanship post, or simply take a verbal reprimand on the Senate floor.
