Embattled former Nets star Jayson Williams has been charged with DWI after allegedly crashing his car into a tree in Manhattan early Tuesday morning while drunk, sources tell NY1.

Authorities say Williams' sports utility vehicle struck a tree shortly after exiting the FDR Drive near 20th Street around 3:15 a.m.

He was taken to Bellevue Hospital with a cut to his head. Sources say he also chipped a bone in his neck.

He was charged in his hospital bed, the Associated Press reports.

Police say it appeared Williams had been drinking before the accident. And, sources say, he refused a breathalyzer.

According to the AP, police asked for a warrant to test blood taken by the hospital for alcohol content.

Williams was in the passenger seat when officers arrived, but witnesses say they saw him in the driver's seat. Officers say no one else was in the car.

According to police sources, Williams claimed that the driver fled the scene, but witnesses and surveillance video does not show anyone leaving the vicinity.

Williams is scheduled to be retried this month on reckless manslaughter charges in connection with the 2002 shooting death of his limo driver. He was convicted of covering up the shooting, but was acquitted of aggravated manslaughter.

The jury deadlocked on reckless manslaughter charges.

Williams retired in 2000 after nine seasons with the Philadelphia 76ers and New Jersey Nets.
