Queens Bias Attack Suspect Returns To New York

The second suspect in an alleged bias attack has been extradited to Queens where he will be arraigned Thursday on charges of assault and robbery, both as hate crimes.
The Queens district attorney's office says Daniel Rodriguez, 21, was transported from Norfolk, Virginia to the city Wednesday. He waived his extradition rights earlier in the morning after being arrested Tuesday night.
Officials say Rodriguez will be arraigned on assault and robbery charges, both as hate crimes, in connection to the Friday beating of 49-year-old Jack Price.
Surveillance video has been released showing two men punching and kicking Price to the ground as he was walking home from a College Point deli. Prosecutors say they shouted anti-gay slurs.
Price is hospitalized with two collapsed lungs, a lacerated spleen, broken ribs and a broken jaw.
"It's a despicable crime,” said Police Commissioner Ray Kelly. “The individual was attacked specifically for his orientation; we will not tolerate that in this city. We aggressively investigate any hate crime."
Another suspect , Daniel Aleman, 26, was arrested Sunday and faces similar charges.
