Officer Charged With DWI Had Blood Alcohol Level Of Zero

Sources say an off-duty officer charged with mowing down a minister's daughter while allegedly driving drunk on Sunday had a blood alcohol content of zero.
Andrew Kelly was tested about seven hours after hitting Vionique Valnord in Brooklyn. The finding does not mean Kelly did not have alcohol in his system earlier.
Police Commissioner Ray Kelly said yesterday there is a formula to determine how quickly alcohol dissipates in the body. He says the delay in getting the test is not unusual under New York law.
Sources say authorities still have key evidence, including an admission from Officer Kelly that he had been drinking, and video of him drinking at a bar before getting in his car.
Kelly is charged with vehicular manslaughter and DWI.
He has been suspended by the New York City Police Department and is due back in court Friday.
Another off-duty officer who was in the car has been suspended for 30 days and faces departmental charges.
A funeral for Valnord is planned for Saturday.
