The city is vowing to fight a lawsuit by a Brooklyn man suing the New York City Police Department after he was allegedly sodomized by officers.

Lawyers for the NYPD filed papers in federal court asking a judge to remove the police department from a $220 million civil suit filed by Michael Mineo.

In court papers, the NYPD argues that it should be removed from the case because Mineo, 24, failed the state a claim against the department directly.

Mineo claims he was chased down by officers, beaten and sodomized with a radio antenna last year at a Prospect Park subway station.

The three officers charged in the attack have denied his claims.
