The dispute at the World Trade Center site could end up being resolved through binding arbitration.
Developer Larry Silverstein says he will go to an arbitrator if he and the Port Authority can't reach an agreement in 10 business days.
The two sides have been at odds for months over financing for the proposed towers.
In a statement, the executive director of the Port Authority says Silverstein is "walking away from the negotiating table."
Mayor Michael Bloomberg has tried to resolve the dispute and is accusing the Port Authority of not doing enough to reach a resolution.
