The Call Blog: Watering Down Gun Legislation?

By: NY1 News

Have something to tell us at The Call? Drop us a line at thecall@ny1.com and we'll post it to our blog.

In response to Senate Majority Leader Harry Reid's decision to remove the assault weapons ban from gun legislation, Senator Dianne Feinstein said: "The enemies on this are very powerful. I've know that all my life."

She was referring to the NRA, and she is right. It's a sad day when politics comes before the lives of innocent civilians. But, it's not a new concept.

Feinstein said: “To have these mass killings is such a blight on everything that America stands for." Unfortunately, greed continues to get in the way of what America stands for.

Governor Cuomo insists he is not necessarily “rolling back” the State’s gun law passed in January. Cuomo and Legislative leaders plan to change a portion of the legislation before a provision kicks in banning the sale of ten-bullet magazines. This issue is the gun measure outlaws magazines that carry more than seven bullets, but seven-bullet magazines are not made. Cuomo said guns can be sold with ten-shot magazines, but New Yorkers still will be required to keep no more than seven bullets in them, unless they are at shooting range or in competition. Cuomo and Democratic leaders insist the change will not weaken the law, considering the ban on assault weapons will remain untouched.

This comes a day after Senate Democratic leaders announced they are removing the assault weapons ban from the firearms legislation the Senate is expected to debate next month. Majority Leader Harry Reid says he wants to bring a gun bill to the Senate with enough support to overcome any Republican efforts to block debate. And, he was concerned that opposition to the assault weapons ban would block the passage of any bill at all. Many Democrats think a ban on large-capacity magazines has a better chance of getting 60 votes. California Democratic Senator Dianne Feinstein, who sponsored the provision, says she will now offer her ban as an amendment.

Do you agree with the decision to remove the assault weapons ban from federal legislation? Do you agree with banning the sale of large-capacity magazines on a national level? What’s your reaction to Governor Cuomo’s decision to rework a portion of the State’s gun law? Do you agree with the State’s seven-bullet requirement?

It is beyond comprehension as to why the Congress could not and did not pass an Assault Weapons Ban Bill. How many more mass killings with assault weapons will occur in this country before Congress wakes up? Sandy Hook was an absolute horror, which touched the entire country and the world. It is high time that the politicians in this country stand up and and have a strong backbone and fight for a total ban on assault weapons -only military and law enforcement personnel should be permitted to carry these weapons while on the job only. The quality of life and respect for life in this country is sinking faster than the Titanic did.Our politicians who voted against this bill should be ashamed of themselves and really examine their consciences. They are a disgrace!

Senator Reid and other democrats are obviously too beholden to the NRA to bring the assault weapons bill for a vote, this despite the testimonies of the families of the Newton children who were tragically killed by the use of this weapon, which has no purpose in our streets other than for mass killings.

I'm opposed to the disarming of America no matter what form it takes. All of these regulations and bans are in direct violation of the 2nd Amendment to the US Constitution.

No there should be no ban on the amount of bullets. If Cuomo made a mistake he should admit it. He was told about it from the beginning and now he's trying to tell us that it's not a roll back. Just how long are these politicians in office in New York State? A long time and they still know nothing about gun laws and the topic in itself. They look mighty foolish. Besides all of this it won't matter at all because people will still have or get access to fire arms or weapons of any and every kind to be had. They are always a step ahead. So you all are following one another thinking you will solve the problem and it isn't going to happen.

What about the drug situation? People are driving under the influence of drugs and alcohol constantly and get away with it.

CUOMO SHOULD JUST THINK FOR A MOMENT ABOUT HOW RIDICULOUS IT SOUNDS TO TELL SOMEONE TO COUNT HOW MANY BULLETS TO HAVE IN THE CHAMBER. [SO IF THE CHAMBER HOLDS 10 YOU MUST DEDUCT IN ORDER TO COME UP WITH A 7 COUNT AND JUST WHO WILL BE THE ONE TO ENFORCE THIS].

SO I THINK IT'S TIME TO STOP HARASSING THE LEGAL GUN OWNERS.

I'd STILL like to know who is going to get the guns out of the hands of the CRIMINALS? The ban only affects law abiding citizens. Politicians just make me Laugh Out Loud! I think they ALL need an MRI just to determine IF they have a BRAIN!

I won't comment on the Albany maneuvering -- I will say, however, that unless the law allows for the use by legitimate gun owners of a product that is, indeed, manufactured and available, that could become the basis for a successful constitutional challenge to the law in federal court.

It's disgusting that these gun supporters are much more scare di of the NRA than the will of the majority of sane Americans. How many more Columbines, Auroras, Newtown innocents have to be murdered before Harry Reid and cohorts ban assault weapons? It's despicable and insane that murder is so easy in the USA.

This is absurd. I feel Constitution Amendment needs to be repeal. Only law enforcement officers, & our Military Men & Women should be able to carry fire arms. All fire arms should be BANNED for sale to all Citizens....

The Governor will be doing more than rewriting the magazine part of his law, once it gets into the courts I think they will side with the plaintiffs suing to over turn his law. He will not have the support he had last time in getting this passed.

Those who contend that the second amendment precludes gun control should read it.

It states: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

Presuming the right to bear arms is limited to the purpose of maintaining a well regulated militia, then only those in the military and law enforcement have an absolute right to bear arms. The rest of us are subject to regulation.

Bill (Manhattan)

I think that having a reduction on the of rounds a individual can have in there mag, unnecessarily and unfairly places that individual in legal jeopardy if they had to defend them against a dangerous criminal, making the victim the criminal when we just want to protect our selfs and our families...

Someone said 8 kids are killed each day by guns. That's not true; according to the FBI statistics 2006-2010 there were 561 deaths of children attributed to guns. Don't use fabricated statistics as a scare tactic to get your legislation passed.

How does the constitution protect assault riffles? Were they in existence?

My thoughts are is gun should be governed, but think about like this if someone breaks into your home, you don't know what they intend to do, and you have to call a person with a gun, to protect you, ( the police), NYPD, and do you think if someone at you place o of residence, that police will make it there to save you!!!
