A Bronx judge tossed out a lawsuit Tuesday challenging Governor David Paterson's move to recognize gay marriages performed out-of-state.
In a ruling Tuesday, Judge Lucy Billings said the policy is a step toward equality for gays and lesbians.
A coalition of conservative groups filed the lawsuit in June, claiming the governor violated the separation of powers when he directed state agencies to recognize same-sex marriages legally performed out of state.
Paterson has said the move was meant to protect the state from potential discrimination lawsuits from couples with valid marriage licenses.
