Former State Senate Majority Leader Joe Bruno appeared in court in Albany Friday as prosecutors seek to retry him on new charges.

It comes after the U.S. Supreme Court ruled to overturn portions of the Honest Services Law that Bruno was originally convicted under.

Three judges will now consider whether the changes were significant enough to warrant a new trial.

Bruno says he's tired of the ongoing investigation.

"The prosecutors want a chance to re-try me after three-and-a-half years of investigating on charges that they couldn't bring and didn't bring," said Bruno. "And so other than being frustrated and exasperated, I have full confidence in the system."

Bruno was originally convicted of violating the Honest Services law in 2009.

Prosecutors say he abused his position by secretly accepting millions in contracts from companies and unions that work with the state.

He appealed that decision and thus far has not served any jail time.

It could take anywhere from weeks to months for the judges to decide if he can be re-tried.
