New York State is taking steps to get a waiver from the No Child Left Behind Act.

The 2001 federal law requires all students to be proficient in both reading and math by 2014.

The State Board of Regents approved New York's application for the waiver Monday, but to get the waiver from the Obama administration, the state must have a comprehensive teacher evaluation system.

The New York State Education Department and the teachers union have been unable to agree on one.

Governor Andrew Cuomo has now given the education officials and union members until Thursday to come to a compromise.

If they don't, he will write a new evaluation law into the state budget.

Last week, President Barack Obama granted waivers to 10 states.
