Groups File Suit Against Department Of Education Over Freedom Of Information Law

Two groups have filed lawsuits against the Department of Education, alleging it doesn't comply with open access laws.

Members of Advocates for Children of New York and the Asian American Legal Defense and Education Fund want the department to release certain records as required by the state Freedom of Information Law or “FOIL.”

The outstanding FOIL requests seek data related to students whose primary language is not English and students with disabilities.

A lawyer for the plaintiffs said the DOE cannot claim to be accountable to the public if it withholds basic information.

NY1 also has several FOIL requests with the department. Officials from the DOE said the department will review the lawsuit.
