No criminal charges will be filed in the case of a 12-year-old Manhattan student who drowned off Long Island on a field trip.

Nicole Sureil was out in the waters off Long Beach when she was caught by a rip current and drowned back in June.

Nassau District Attorney Kathleen Rice says while Nicole's death was tragic, the evidence does not support criminal charges.

Nicole was out with her sixth-grade class from Manhattan's Columbia Secondary School. Authorities had said signs were posted that prohibited swimming while lifeguards were not on duty.

The incident resulted in the firing of one teacher and the demotion of the assistant principal.

The school's principal was given probation.

A civil lawsuit against the city is still pending.
