A Manhattan state appeals court Thursday affirmed the decision by the state supreme court to not allow the Department of Education to close 19 city schools.

The First Judicial Department of the New York Appellate Division ruled 5-0 to keep the schools open.

Mayor Michael Bloomberg called the latest decision outrageous and accused the union of trying to save jobs at the expense of city students education.

"What it means is that there's a whole bunch of kids, that at least for one year, will get a terrible education that they will probably never recover from," said the mayor.

A city education panel voted on January 26 to close the schools because of poor performance, but the teachers union and the NAACP filed a lawsuit.

In response to the decision, President Michael Mulgrew of the United Federation of Teachers released the following statement: “No one is above the law, and every court that has looked at this issue has ruled decisively that the Department of Education violated the law when it tried to close these schools.”

Some teachers who spoke with NY1 say they hope the schools may get a second chance.

"I am worried that we are in for more of the same next year but I am hoping that maybe this decision will give them pause and make them reconsider and look to support us in the future," said Academy of Environmental Science teacher Dan Simoes.

The City Law Department said it will review its appellate options.
