The city got the green light to test out a program that would let people hail yellow cabs with their smartphones.

A Manhattan judge on Tuesday dismissed a lawsuit that sought to put the brakes on the "e-hail" program.

Livery cab owners claimed it would violate a law that prohibits drivers from refusing passengers without grounds.

The judge says the e-hail plan might actually prevent discrimination, because it would make drivers accept passengers before seeing what they look like.

Taxi and Limousine Commissioner David Yassky says the decision is a victory for riders.

TLC officials have agreed to try out the system for a year.

There is no word yet on when the pilot program would start.
