One of the city's biggest charter school organizations is suing the state comptroller's office for wanting to conduct an audit.

Success Academy Charter Schools argues that the comptroller's plan to audit one of its schools next week is unconstitutional.

The charter organization is citing a precedent set in a case in 2009, in which the state Court of Appeals ruled that the legislature overstepped its boundaries with a law that made the comptroller's office responsible for auditing charter schools.

Success Academy operates 14 charter schools in the city and is working to add eight more.
