The city is going to a higher court to try to delay a judge's order to change stop-and-frisk, pending an appeal.

Federal judge Shira Scheindlin refused to grant the city's request for a stay Tuesday, saying it would send the wrong message.

She ordered the changes after finding the program discriminates against minorities, and told the city to keep trying to make changes.

The city says it's going to the Second Circuit Court of Appeals in the next few days to try to get that stay.
