A man plans to sue the city after a police car hit the back of a dirt bike he was riding in the Bronx earlier this month, injuring him and killing his friend.
Adalberto Gonzalez, 26, is filing a notice of claim, alleging police officers did not follow proper procedures.
Police say they noticed Gonzalez driving his dirt bike the wrong way on Manida Street in the Hunts Point section of the Bronx on August 11.
Investigators said the officers did not stop the bike, but when they later tried to walk up to Gonzalez, he ran off and hopped onto another bike driven by his friend Eddie Fernandez.
Authorities said a marked police car accidentally hit the bike as it started to drive away.
Police say it was not an attempt to stop the bike.
Fernandez was killed and Gonzalez broke his leg.
Gonzalez was arrested and is charged with reckless endangerment, fleeing an officer, and resisting arrest.
The City Law Department said it will review the facts thoroughly.
