A State Supreme Court judge refused Thursday to dismiss an indictment accusing Brooke Astor's son of stealing millions of dollars from his late mother.

Lawyers for Anthony Marshall, 83, say Manhattan prosecutors failed to provide enough evidence for the indictment, but the judge said the case will proceed.

The judge also upheld charges against Francis Morrissey, Jr., who prosecutors say helped Marshall raid his mother's estate of nearly $200 million in art, real estate and cash.
