Tracy Morgan is suing Wal-Mart over last month's highway crash that left him critically injured.
The comedian accuses the retail giant of being negligent, claiming it should have known its truck driver—35-year-old Kevin Roper—was overtired after being awake for more than 24 hours and driving 700 miles.
Morgan also alleges Roper fell asleep at the wheel when he slammed into the back of his limousine van on the New Jersey Turnpike on June 7.
A report by federal investigators shows Roper was speeding just before the accident.
The crash also killed Morgan's friend and fellow comedian, James McNair.

Morgan is demanding a jury trial and punitive and compensatory damages.
