The family of a Bronx woman whose body was mistakenly sent for medical study is now suing the city.

Hector Ballesteros says the medical examiner's office agreed to hold his mother Aura's body for a month after she passed away May 16.

He says he went back for the body June 5, and found it was mistakenly sent to the Albert Einstein College of Medicine for teaching purposes.

The family is now seeking $5 million in damages from the city.

"This is like another loss, besides to lose my mother now is like we lost something else and that's the violation of my mother's body."

The family says the body was damaged, but the Medical Examiner's office says it was returned before any teaching activities occurred.
