The owner of a construction crane that collapsed in 2008 is trying to delay the wrongful death trial, saying he was hurt in a car accident.

A lawyer for James Lomma made the request for a delay or mistrial Thursday, saying Lomma had been severely hurt in a car accident just over a week ago and would need two to three months to recover.

Lawyers representing the families of two people killed in the accident say Lomma is trying to avoid trial.

Manhattan State Supreme Court Justice Manuel Mendez says he needs to see a police accident report and a doctor's statement before deciding.

Opening statements in the trial began last Friday, Lomma has not yet appeared in court.

He was acquitted of all criminal charges.
