A local smokers' rights group wants to stamp out the city's ban on electronic cigarettes.

The NYC Citizens Lobbying Against Smoker Harassment filed a lawsuit to overturn e-cigarettes' addition to the city's Smoke Free Air Act.

That was approved by the City Council and signed into law by outgoing Mayor Michael Bloomberg at the end of December and it bans e-cigarettes anywhere regular cigarettes are banned.

The suit claims adding e-cigarettes to tobacco smoke regulation violates the city charter's "One Subject Rule," which restricts legislation topics to a single subject.

CLASH says the City Council added e-cigarettes to the act because they have not been approved by the FDA and they believed they would encourage smoking. But they say the Smoke Free Air Act has always been about protecting people from involuntary second-hand smoke exposure.
