A woman sues the city saying she was hurt when a sanitation truck sent a wave of slush through a cafe window in Queens.

This surveillance video taken Feb. 13 shows diners at the E.X.O. Café on Austin Street in Forest Hills being slammed by the mess.

It carried enough force to knock the woman from her chair.

Now, her lawyer says she's still dealing with injuries and they're shocked the driver was not ticketed.

"It's just been a lot of pain. My back got injured - my lower back, my middle back, my shoulders, because I was the one not facing the window," said Victoria Martini, the woman who was struck.

"I've never seen a police report in all the years I've been practicing law where somebody leaves a scene and doesn't get a ticket. How is that possible?" said Martini's attorney Seth Harris.

Harris says Martini is waiting for medical test results and will seek, quote, "fair and reasonable compensation."

The city Law Department has yet to respond to NY1's request for comment.
