The mother of a 5-year-old boy who walked home from his Brooklyn school with a good Samaritan after getting locked out is filing a notice of claim to sue the city.

Sharon DeVore-Nelson is seeking $5 million in damages from the Department of Education for the emotional damage suffered by her son, Malachi Nelson.

Malachi, who has cerebral palsy, told his mother that he walked out of the Lefferts Gardens Charter School through a side door after his teacher told him to go find a bus matron.

His mother said that the boy was approached by an unidentified man on the street, who walked him home.

"Whoever this man is, I just want to say thank you for bringing my baby home because this could have been worse. This could have been like Avonte [Oquendo]," Devore-Nelson said.

"We're very grateful to the good Samaritan who came by and took this child home, but horrible things could happen when 5-year-old children are wandering around," said Sanford Rubenstein, the family's attorney. "And we know what happened to Avonte Oquendo, and we don't want that to happen to any child in this city."

Avonte disappeared from his school in October, and his body was found in Queens after a massive search.
