The parents of a boy struck by a school bus in the Bronx earlier this month are planning to sue the city police department, the bus company, and the driver.

Ivan Delacruz, Jr., 6, was hit on January 16 while crossing an intersection with his older sister near the Santa Maria Catholic School in Parkchester.

The boy's leg was badly injured, and he only got out of the hospital this week.

The usual crossing guard had called out sick the day of the accident, and a replacement didn't get there till after the boy was hurt.

The boy's parents are expected to file a notice of claim Friday to sue the police department, citing negligence in not replacing the guard in time.

They will also seek unspecified damages against the bus driver and the Little Richie Bus Service.
