A smokers rights group has filed a lawsuit against Hudson River Park, saying the smoking ban there is unconstitutional.

The riverfront park voted to ban smoking in 2012, but Citizens Lobbying Against Smoker Harassment says only the State Legislature has the authority to do that.

Former Mayor Michael Bloomberg signed a bill banning smoking in all city parks in 2011, but Hudson River Park is jointly administered by both the city and state government.

The suit was filed in Manhattan Supreme Court.
