Ten motorcyclists involved in an attack on a SUV in Manhattan in September could see their charges reduced.
Prosecutors say they will likely downgrade the assault and gang assault charges because the victim was not seriously injured.
The incident was videotaped and posted online.
It began when Alexian Lien's vehicle bumped a slow-moving cyclist.
The group, which included an off-duty police officer, is accused of chasing him up the highway, pulling him from his vehicle and beating him.
Lien suffered cuts to his head that required stitches.
The new charges would be attempted assault and attempted gang assault, which carry shorter maximum jail sentences.
