The cab driver involved in a summertime accident that cost a British tourist her left leg will not be charged.

Tourist Sian Green was walking along 49th Street near Sixth Avenue back in August when she was hit by a taxi driven by Faysal Himon.

Himon maintains that his cab jumped the curb and hit Green because of an argument with a bicyclist.

In a statement, the Manhattan district attorney's office said, "The Assistant District Attorney indicated that failure to charge was due to lack of evidence regarding the taxi cab driver's intent during the investigation phase."

In backing the cabbie, the New York State Federation of Taxi Drivers urged more regulations on cyclists.
