A lawyer for the family of a national guardsman shot and killed by an New York City police detective says federal prosecutors are launching a preliminary investigation into the incident.
The probe will look into whether there were civil rights violations committed.
Noel Polanco, 22, was shot during a traffic stop on Grand Central Parkway in October 2012.
Police say Detective Hassan Hamdy shot Polanco because he appeared to be reaching for a gun, but no weapon was ever found.
Hamdy maintains that he acted within the law.
Polanco's family has filed a wrongful death lawsuit against the city and the NYPD.
