The Manhattan District Attorney's Office has decided not to prosecute two high-level NYPD officials accused of assaulting Occupy Wall Street protesters.

Deputy Inspector Johnny Cardona is accused of assaulting a man, while Deputy Inspector Anthony Bologna is also accused of pepper spraying a female protester.

After an investigation, the DA's Office said they cannot prove the allegations were criminal beyond a reasonable doubt.

A law enforcement source told NY1 that officers were reacting during a chaotic scene, and that evidence before and after the incidents makes the criminality of their actions doubtful.

Bologna did receive departmental discipline.

An attorney for the complainants said he intends to request an independent, possibly federal, investigation of the incidents.
