A man accused in a deadly hit-and-run accident that killed a grandmother on Staten Island entered a not-guilty plea today.
Brian McGurk, 40, seen above, is charged with criminally negligent homicide and leaving the scene of an accident.
Authorities say McGurk allegedly struck and killed Clara Almazo, 56, who was walking home from a Mass on Cary Avenue on April 5.
Police say Almazo's eight-year-old grandson Ryan was with her at the time, and Almazo was able to push him out of harms way.
The child suffered a broken leg.
Almazo's family is suing McGurk, as well as the New York Mets and a local bar.
They claim McGurk was allowed to drink too much at both locations before getting into his car.
The Mets are not commenting on the suit.
