Federal officials say a deadly bus crash last year in Virginia was likely caused by driver fatigue and several other factors.
Driver Kin Yiu Cheung of Flushing faces four counts of involuntary manslaughter.
He allegedly fell asleep at the wheel of the bus that was traveling from Greensboro, North Carolina to New York.
Investigators say he had a maximum of six-and-a-half hours sleep and could not stay awake despite drinking coffee, energy drinks and talking on his cell phone.
His attorneys call it a tragic accident.
The trial starts in November.
Four people were killed and dozens injured when the bus flipped on Interstate 95 just north of Richmond last May.
The National Transportation Safety Board says the low-fare bus company, Sky Express, had no regard for passenger safety.
They also say ineffective government oversight let the company operate despite various safety violations.
