The son of late philanthropist Brooke Astor is staying out of jail, for now.
A state supreme court judge agreed Monday to let 85-year-old Anthony Marshall remain free on bail as he appeals his conviction.
Marshall was convicted of taking advantage of his mother's failing mind to steal from her nearly $200 million fortune.
An appellate court judge also raised his bail from $100,000 to $500,000.
Marshall was sentenced to one to three years in prison and was supposed to begin serving time next week.
