A Nassau County judge has blocked Governor David Paterson from naming former MTA head Richard Ravitch as New York's lieutenant governor.

The ruling was issued late Tuesday afternoon by State Supreme Court Justice William LaMarca.

"Were the governor to die, resign, or be removed from office,
Mr. Ravitch, if allowed to remain in office, is next in the line of
succession," LaMarca said in a written statement. "For an illegally appointed lieutenant governor to act as governor of the state would clearly constitute irreparable harm."

Ravitch was appointed by the governor earlier this month in an attempt to break the legislative stalemate in Albany.

Those opposed to Paterson's decision, including State Attorney General Andrew Cuomo, argued the state's constitution did not allow the governor to name a replacement in the event of a vacancy.

The governor's motion to move the venue to Albany was also rejected.

In response, a spokesperson for Paterson released a statement saying, "Governor Paterson's appointment of Richard Ravitch as Lieutenant Governor is legally sound and we are confident the appellate courts will ultimately rule in our favor. We will go to the Appellate Division, Second Department, tomorrow to seek to have the preliminary injunction lifted."

Another court hearing in the case is scheduled for August 25th.
