The former New York City Police Department officer acquitted of rape will not be facing additional charges on drug possession.

A judge dismissed the misdemeanor drug case against Kenneth Moreno.

Heroin was allegedly found in Moreno's locker during a search by police investigating the rape case.

The lead prosecutor told the judge Monday there was no purpose in proceeding with the two misdemeanor drug charges given that Moreno had already received a one year jail sentence for his misconduct conviction stemming from the rape case.

Moreno was acquitted in May of raping a drunk woman in her East Village apartment.
