Rape Case Against Two Police Officers Adjourned

A rape case against two city police officers is heading back to a grand jury.

The last-minute turnaround from prosecutors came just as jury selection was set to begin Monday for Police Officers Kenneth Moreno and Franklin Mata.

The Manhattan district attorney's office says it is presenting the case to the grand jury, but did not disclose why.

Defense lawyers claim prosecutors initially did not present evidence to the jury that bolsters the officers' innocence. But the DA's office says that claim is "entirely inaccurate."

Prosecutors allege Moreno raped a drunk woman while Mata acted as a lookout.

The officers had escorted the woman to her East Village apartment in December 2008.
