Giants WR Plaxico Burress Arraigned On Gun Charges

Giants' wide receiver Plaxico Burress was arraigned on gun charges Monday afternoon, hours after turning himself in to police.

He did not enter a plea to charges of criminal possession of a weapon in the second and third degree, and was released on $100,000 bail.

Burress accidentally shot himself in the leg on Friday night at The Latin Quarter Nightclub in Midtown. The injury is not believed to be serious.

He was treated and released from New York-Presbyterian Hospital/Weill Cornell Medical Center Saturday.

Burress was arrested after he surrendered at the 17th Precinct station house in Midtown this morning.

While he did not address reporters, his attorney, Ben Brafman, called his client a "fundamentally decent man in a difficult situation."

"We will deal with the legal process in a responsible, professional manner," said Brafman. "He is standing tall. He's a mature adult handling this, I think, very well under the circumstances."

Burress' charges carry a minimum prison sentence of 3.5 years and a maximum of 15 years for each count.

At a news conference Monday, Mayor Michael Bloomberg said he hopes Burress will be prosecuted to the fullest extent of the law.

"I don't think anybody should be exempt from that, and I think
it would be an outrage if we didn't prosecute to the fullest extent
of the law, particularly people who live in the public domain, make
their living because of their visibility; they're the role models
for our kids," Bloomberg said.

The mayor also criticized claims that Burress' gunshot wound was not originally reported to police by the hospital, as required by law.

"Not reporting a gunshot wound is a clear violation of our policies and procedures. Mayor Bloomberg has been in touch with us about this matter," said the hospital in a statement. "We take this very seriously, and are conducting a thorough investigation into why this gunshot wound was not reported to the Police Department in a timely fashion."

The NYPD is not confirming reports that Burress' gun was recovered at his home in Totowa, New Jersey, on Sunday.

Burress reportedly had a concealed weapons permit from Florida that expired in May. Had it not expired, it would still not have been recognized by authorities in New York.

Teammate Antonio Pierce was with Burress at the time of the accidental shooting. Pierce was interviewed by National Football League security at the team hotel in Washington, D.C., on Saturday, and played in the Giants game against the Redskins Sunday.

Burress already had been ruled out of the game because of a previous football-related injury.

Published reports say the team is considering placing Burress on the non-football injury reserve list – making him ineligible for the season. It would also allow the team to get back some of the money they paid for the wide receiver.

Burress signed a $35 million, five-year deal earlier this season.

The team is not saying whether Burress will play in Sunday's game against division rival Philadelphia Eagles.

Burress is due back in court on March 31st.
